Halle Berry’s ex Olivier Martinez was granted a temporary restraining order against the actress after accusing her of physically abusing their 12-year-old son, Maceo.
According to People, Martinez’s request was granted on Thursday, October 1. The temporary restraining order applies to both him and Maceo.
Visitation was ordered to be temporarily modified, with partial custody “continued to maintain communication” between Berry, 60, and her son. The judge denied a request for Berry’s sobriety to be monitored, citing “insufficient information.”
Berry’s visitation time was limited to Mondays and Tuesdays between 10 a.m. and 8 p.m., as well as Saturdays and Sundays from 10 a.m. to 8 p.m.
The temporary restraining order will be in place until a hearing is held later this month. The judge will then determine whether the order should be made permanent.
News broke on Thursday that Martinez, 60, filed a request for a domestic violence restraining order. In documents obtained by Us, Martinez described an alleged incident that took place on September 26, claiming Maceo called him asking to be picked up from Berry’s home after she “physically attacked him and choked him.”
“While on the phone with our son, I heard him panicking and heard [Berry] still yelling at him in the background,” Martinez alleged. “When I arrived [Berry] did not come out of the home but [her] partner assisted our son in carrying his bags to my car.”
Martinez claimed Berry texted him the following day to apologize. He further alleged that it was not the first time Berry had been physical with their son, claiming she previously put Maceo in “choke holds” while training in “mixed martial arts.”
According to Martinez, Maceo seems “traumatized” by the alleged altercation and does “not want to spend time” at Berry’s house. He asked for the pair’s 50-50 custody agreement to be temporarily changed to a “no contact order.”
“I do not want to permanently sever the relationship between our son and [Berry],” the docs stated, “but I do not believe that they should be interacting with each other until [Berry] can take sufficient accountability for her actions.”
Berry’s lawyer addressed the accusations in a statement to Us on Thursday.
“To say this filing is entirely meritless and deliberately misleading would be an understatement,” attorney Marina Beck said. “There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo — misconduct for which Mr. Martinez has already been legally sanctioned.”
The statement continued, “In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior. Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
Berry and Martinez dated for three years before getting married in July 2013. The pair welcomed Maceo that same year. Martinez and Berry separated in October 2015, later battling over custody arrangements. Their divorce was finalized in August 2023, seven years after they were legally declared single.
